Digital Image Usage and Licensing

Social Pic Society LLC grants Purchaser non-exclusive, non-transferable, perpetual limited-use license to download the photos subject to the following restrictions:

Purchased photos may be included as part of the membership service contract through the Social Pic Society online store. 

The rights granted to User are non-transferable and non-sublicensable (User cannot transfer, license, or sub-license to anyone else).

Liability Limitation

Social Pic Society LLC will not be liable for any third party claims or incidental, consequential or other damages arising out of this license, member, or buyer’s use of our digital products or services. Social Pic Society LLC shall not be liable for any claims related to, or resulting from, members’ use of the images, which may or may not have been modified by a member, or combined with other content.

Members acknowledge that Social Pic Society LLC does not make any representations or assurances of non-infringement and does not make claim to have received releases from any brands, designers, or manufacturers for use of products, registered trademarks, logos or intellectual property portrayed in the images. 

Content Property

User acknowledges all Content, including but not limited to, images, graphics, logos, icons, text, captions, audio and video clips, digital downloads, data compilations, and software (individually and collectively “Content”), contained on socialpicsociety.com is the sole and exclusive property of Social Pic Society LLC or the property of our licensors or licensees, and the compilation of the Content on the Site is the sole and exclusive property of Social Pic Society LLC, protected by United States trademark, trade dress and copyright law. User may not transfer her/his subscription, transfer Content, sell, lease, assign, or give away or anything similar thereof to a third party.

User Rights 

This license can be used for personal or commercial use; copyright, title ownership, and all rights now and in the future, remain exclusively with Social Pic Society LLC. There are no warranties on any of the photos, express or implied. Photographs are provided ‘as is.’ The rights granted to User are non-transferable and non-sublicensable (User cannot transfer, license, or sub-license to anyone else).

Heather Cherie Photography LLC with Social Pic Society LLC retains all rights, license, copyright, title and ownership of the photography on socialpicsociety.com.

Where the main value lies in the Content itself, you may not use Content in connection with any goods or services intended for resale or distribution.

Usage and Content Creation

 - Using content purchased through your membership entitles you to these usage guidelines: You may: 

 - Display on personal websites and computers.

 - Use the images in digital or print advertisements.

 - Crop, scale, and/or rotate the image to fit Purchaser’s promotional needs.

 - Overlay the image with Purchaser’s text, graphics, or pdfs.

 - Use the images to promote your own business, products, and/or services on your website and social media channels.

 - User may edit, alter and/or manipulate images as long as User does not violate any restricted uses. Additionally, User may not edit, alter and/or manipulate images, including but not limited to, content containing profanity, sexually explicit material, unlawful material, hate speech or any other offensive material.

Prohibited Uses

However, given the copyright restrictions, here are the prohibited actions for members. 

Purchaser may NOT:

 - May not claim Social Pic Society images as their own.

 - Resell, relicense, sub-license, redistribute without express written permission from Social Pic Society LLC.

 - Use the photographs in a pornographic, obscene, illegal, immoral, libelous or defamatory manner.

 - Additionally, User may not edit, alter and/or manipulate images, including but not limited to, content containing profanity, sexually explicit material, unlawful material, hate speech or any other offensive material.

 - Scan, share, copy, duplicate, distribute, or otherwise reproduce the images, to allow a third-party to use the images in any way.

 - Use this purchase to promote photography styling related workshops, classes, flat lay tutorials/blog posts or any on or offline photography-related training.   - User may not use Social Pic Society images to promote stock image related trainings (workshops, online courses, webinars, newsletters, blog posts).

Incorporate photographs into trademarks, logos, or service marks, design mark, trade name, business name.(You may overlay your own logo on the image, but the image itself MAY NOT be used as a part of a logo.)

 - May Not Make available for download. 

 - User may not transfer the images to customers or clients, even if images have been modified in any way, including but not limited to adding graphics or text. User may not Create derivative products from the images such as templates, screensavers, quote graphics, desktop calendars, printables, art prints, mugs, calendars, clipart, invitations, screensavers or any such products, either for sale or to give away for free.

Restricted Uses

Unless User has purchased a Multi-License Subscription, User may not use Social Pic Society Content for other people, other businesses, or other accounts and social media platforms. Each subscription is an individual account for one (1) sole member. If using images for others and has not purchased a Multi-License Subscription, a separate subscription must be purchased for each client/account. One (1) usage license is granted per purchase.

User may not allow or grant permission to other companies or individuals to repurpose Content for commercial, promotional, endorsement, advertising or merchandising purposes.

Where the main value lies in the Content itself, you may not use Content in connection with any goods or services intended for resale or distribution.

We welcome graphic and web designers and social media managers to be part of this membership program with an Agency Membership (multi-license commercial membership) when using images for your client work. The following usage restrictions apply to single license memberships: 

 - You may use the images as part of a graphic/web design project only as a SAMPLE for a non-member client and without an Agency Membership.

 - You MAY NOT resell or freely distribute single images to your client, apart from a sample for a design project. Note that design projects are classified as digital or print projects that require MORE design elements than a single image, such as, a new website, social media design cover or print brochure.

 - You MAY NOT create derivative products from the images such as digital templates, screensavers, printables, desktop calendars, wallpapers, art prints, mugs, calendars, clipart/vectors, invitations, or any such products, either for sale or to give away for free. For example, these products are typically posted and sold on multi-vendor websites like Society6, Etsy, Envato or Creative Market.

Commercial Memberships

Agency Memberships are Multi-License Commercial Memberships that allow a User to use Social Pic Society images in the creation of content for the User's clients for marketing, social media, website and branding, advertising, and other promotional uses. Agency Memberships do not have limitations on the number of clients the User can use Social Pic Society images for. Agency Memberships do not allow the transfer of images to clients or third parties, but can only be used by the Agency in the creation of work-product for their clients. If the User's client wishes to manage images, please direct them to Social Pic Society to purchase their own membership. Agency Memberships do not include usage of images for the creation of products for resale - please contact Social Pic Society at socialpicsociety@gmail.com to purchase an Extended Commercial License. 

Using the free photos, purchased photos, or downloaded as a member means you agree to this photo usage agreement.

By becoming a User you acknowledge your subscription is a non-exclusive limited use license of all Content provided by Social Pic Society. As a User you may use Social Pic Society for professional use in the normal course of your business and for personal use.
